Thank you all for helping us to build a wonderful Amicus! It has been written, sent, and is now waiting to be seen by the Supreme Court! For those who have signed the document, and wish to see the completed amicus, please let us know and we will show it to you! It turned out really nice! For those who are worried about personal information being shared, don't worry! A special copy which does not contain any personal information has been created just for you guys!

Still Fighting...

Those who know our family probably realize by now that we simply don't give up. I don't know why we are like this, but my family's determination has brought us closer than imaginable. Right now, we are hanging onto our last thread but it is the determination of the community (God bless you all!) that is getting my family through this mess. As of June 10th, our petition for retrial was "denied". In legal terms, the denial means that the court doesn't necessarily agree or disagree with the wrong (in our opinion) judgment of the lower courts, but they don't think that our case is important to the Texas Jurisprudence and therefore the Supreme Court will not evaluate our case. This was simply devastating to us...one would think that tears eventually dry up...but they would be wrong.
Despite this devestating set-back, many of you know that we are not willing to give up. There are 15 days for our lawyer to submit another version of a petition for review to the Texas Supreme Court. We are currently working on gathering support for an Amicus Curiae Brief which also must be submitted before the 15 days are up. We have until June 25th before our time is up. For those who do not know, the term "Amicus Curiae" literally means "friend of the court". In other words, you guys are gathering around the court as friends trying to prevent it from making another incorrect decision. Please let me extend my heartfelt gratitude to all who have offered up their support, their names, and their signatures to strengthen the Amicus Brief that is currently being written. This document is very difficult to put together, not to mention time consuming, and it will soon be completed. In fact, it should be sent off by this Friday. Please pray for us as we work to open the eyes of the Supreme Court and hopefully give Nicholas Justice!

We're working on it!

Hello everyone,
Sorry it has been such a long time since we have commented. There are many things going on right now that will be affecting our fight for Nick's justice. Aside from personal events, we have had some difficulties about trying to get Nick justice via a criminal case. After spending our savings on a trip down to Texas, we have been extremely disappointed by its outcome.
We met personally with the District Attorney down there. Although they were very nice in their attitude toward us, they were very 'hardened' (I say hardened because it is the best word to match what I am trying to express, but this word may not be completely correct in expression) when it came to our plea. In general, the reason the truck driver who killed Nicholas cannot be put in jail is because there was no alcohol or drugs in his system. Though I must ask you, how many drivers out there are negligent without these inhabitants, and how does his lack of drugs/alcohol make him any less negligent?
I cannot understand the DA's reasoning, and thus the truck driver in our case is released on the road with nothing on his record. After many attempts to have something put on his record (even a traffic ticket), we had been (temporarily) quieted with "post-war" sadness. Yet, revived again in our efforts, we push forward.
This absurdity makes us even more determined to give the public the evidence it needs to prove innocence or guilt in the courts. Who can deny their own eyes?

New Updates!

Hello Everyone!
We are soooo very sorry for the delayed input time for everything on our website. Holidays have been kind of sad, and our research process has been quite intensive. We are trying to figure out the most professional, honest, and still personal, way to propose a bill to our state legislatures. It is our hopes that this bill will be striking to our legislature, and that perhaps our bill will become a law! Please wish us well in our thriving for nick's justice.
Also, coming soon, please check back for updates on our letter to the legislature, their responses, and any further actions that are taken. In addition, new updates will be posted regarding our story, memories of nick, inspiring quotes, etc.

Congradulations! We're at 20 followers!

We just wanted to give everyone an update on our current efforts to persue a new law in Nicholas' name.

First, though, we would like to thank our current number of 20 followers! We are so glad we have made it to this mark! THANK YOU! For those of you who haven't joined, please do! Show your support, as well as be updated with new information as this cause starts to pick up! Becoming a follower is easy enough, just click the "become a follower" button on the right hand side of this page. We would like to continue to see a rise in followers as we know there are many of you who have visited but haven't become followers yet!

In other news, we are currently striving to figure out statistics, facts, and other applicable information to further validate our cause. If you find any stories in the news pertaining to car accidents involving trucks please don't hesitate to forward these stories to us in our comments. If you learn any facts that pertain to our cause...again, DONT HOLD BACK! Tell us what you know and include your source!

Finally, spread the word! Keep telling friends, relatives, and coworkers about this site! We would love to see new members as well as reach other families who have suffered the same incident our family went through.
